2. Entry Period: The TELOGIX Authorized Dealer Electrified Truck Contest (“Contest”) commences at 12:00 AM CT on March 1, 2024, and ends at 11:59 PM CT on December 30, 2024 (“Contest Period”). All interpretations of these Official Rules and decisions made by Sponsor relating to the Contest are final.
3. Eligibility: The Contest is open to legal residents of the 50 United States and District of Columbia who are registered with PerfectVision and an authorized dealer principal, corporation member or owner of an active and compliant TELOGIX Authorized Dealer business entity (further known as CONTESTANT). At any time during this contest, eligible entities or sole proprietors may apply and register to become an authorized dealer through the PerfectVision Authorized Retailer Program by calling 1-855-889-6688.
TELOGIX, LLC (“TELOGIX” or “Sponsor”), and its respective parent companies, affiliated companies, subsidiaries, partners, dealers, manufacturers, distributors, sponsors, advertising agencies, promotion and administration agencies and any entity which is involved in any aspect of the creation, production, operation, execution or fulfillment of Contest, and their respective agents, employees, officers, directors, successors and assigns, together with the Sponsor and Administrator will hereinafter be referred to as (“Contest Entities”). By participating in this Contest, contestants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor and by the decisions of Sponsor; (b) acknowledge compliance with these Official Rules; (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and, (d) agree to release and hold harmless Contest Entities from and against any and all claims, injury or damages arising out of or relating to participation in the Contest and/or the use, misuse or redemption of the Grand Prize (hereinafter defined), and for any claim including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action. These Official Rules do not constitute an employment agreement or impose on TELOGIX any obligation to retain any Contestant as an employee, agent, dealer, or independent contractor and does not prevent TELOGIX or any Contestant from terminating any contractual relationship at any time. Participation and prize award are subject to any applicable TELOGIX personnel and corporation policies or restrictions concerning programs such as this Contest.
4. Contest Overview: This is a sales competition based upon the amount of direct aggregate TELOGIX Hosted PBX seats/extension (“TPBX”) new sales during the Contest Period.
a. Baseline (TELOGIX Authorized Dealers with PerfectVision ONLY): The Baseline Target at the beginning of the contest period will be an Authorized Dealer aggregate sum of 2,500 gross new contracted handsets sold for no less than $19.95 each. Any cancelation or non-payment resulting in default, occurring within 90 days of the sales contract date will be disqualified from the contest. New Authorized Dealers added to the program after the contest period has started will be included in the baseline target without penalty or additional requirement. Any inquiry or dispute regarding the Baseline Average must be sent to ETC2024@TELOGIX.com.
b. The Winner will be the Contestant with the highest overall number of TPBX sales. In the event of a tie, Sponsor will choose a Winner, in its sole discretion, based upon the following criteria in order of priority: (1) sum of tying Contestants’ TPBX new sales revenue;(2) total volume of tying Contestants’ TPBX sales; and (3) total tying Contestants’ new sales revenue. TELOGIX reserves the right, in its sole discretion, to disqualify any sales that it deems to be a violation of these Official Rules or any other applicable TELOGIX policy.
5. To Enter:
a. Baseline: The primary, secondary, or commission contacts of TELOGIX Authorized Dealers must opt-in to the contest by approving these Terms & Conditions via Zomentum Partner Access under Telogix Partner Align Agreement
(unless otherwise changed) within the contest period. Failure to do so will result in disqualification from the incentive.
b. Sweepstakes: Upon obtaining a sale, it will be the authorized dealer's responsibility to verify the sale has been commissioned in the Zomentum Partner Portal by the opportunity being at a 'won' status and all documentation signed by the customer and processed by Telogix before the Contest Period closes to be qualified for the Grand Prize. If the contestant does not enter in the required information prior to the end date/time of the Contest Period, the contestant will be disqualified.
6. Grand Prize:
Tesla Cybertruck Cyberbeast Foundry Edition. In compliance with Tesla Cybertruck purchase agreement. Winner will receive a 12 month no cost vehicle on lease agreement. After 12 months, sponsor will provide sales order, agreement, and title free and clear to contest winner. Winner is also responsible for:
(1) all taxes, title, registration, license plate fees, and documentation fees.
(2) full coverage auto insurance in which Telogix, LLC is to be named in said policy as a loss payee (and shall be maintained in effect throughout the lease term, or until the vehicle is surrendered to Telogix, LLC or its designee).
(3) all costs associated with any upgrade/option that is not included with the Grand Prize; and
4) regular maintenance along with the costs related to any excessive wear and tear of the vehicle. Winner must have a valid U.S. driver’s license and proof of insurance to take delivery of Grand Prize.
All Grand Prize details are determined in Sponsor's sole discretion, including model, style, and color. Grand Prize is non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.
7. Winner Selection and Notification:
a. Baseline: Any disputes regarding the contestant’s status in the competition must be sent to ETC2024@TELOGIX.COM
within the Contest Period. Any disputes sent after the Contest Period closes will not be considered. TELOGIX will determine the Winner based upon a review of final sales reports from the Zomentum Partner Sales & Opportunity share/track platform for the Contest Period which will occur on December 30, 2024. TELOGIX will announce the Winner at the New Year’s Eve Celebration at PerfectVision's Headquarters or via YouTube Live Stream on December 31st, 2024, at 10PM CST.
b. Sweepstakes: The winning entry will be announced live. Attendance is not required to win.
8. Affidavit of Eligibility and Releases: TELOGIX, in its sole and absolute discretion, may require that, in order to be eligible to be declared a Winner and to receive the Grand Prize, the potential winner must sign: (a) an Affidavit of Eligibility and Release releasing Contest Entities from any and all liability, loss, claims, demands, and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss, or any other harm suffered directly or indirectly from potential winner’s participation in Contest, including, but not limited to, traveling to, preparing for and/or participating in any Grand Prize related activity, or the acceptance, possession, or use or misuse of any Grand Prize, to be eligible for the Grand Prize; and (b) except where prohibited by law, a publicity release granting Contest Entities the right to use potential winner’s name, picture and/or likeness, or biographical information or voice for trade, advertising and publicity purposes, in any media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration or notification. If potential winner does not sign these releases and documents within the time frame specified, the potential winner may be disqualified, and the Grand Prize forfeited. When properly executed, and providing potential winner follows the Official Rules, potential winner will be determined to be the Winner (“Winner”). Sponsor expressly reserves the right to delay the announcement of the Winner for any reason Sponsor deems necessary. Winner also must acknowledge that Contest Entities have not and will not obtain or provide insurance of any kind relating to the Grand Prize and that Winner will be responsible for obtaining and paying for any life, travel, car, accident, property, or other form of insurance relating to the Grand Prize. Winner must also complete any additional legal documents provided by Administrator or Sponsor with respect to the Grand Prize and return them as instructed within the time frame specified or Winner may forfeit Grand Prize at Sponsor’s sole discretion and an alternate potential winner may, in Sponsor’s sole discretion, be chosen from among all the remaining Eligible Entries received.
9. Grand Prize Terms: Subject to the availability of the prize from the manufacturer and supplier(s) thereof, Grand Prize will be fulfilled within approximately 2 weeks after the Winner is announced, but subject to change in Sponsor’s sole discretion. All prize details are determined in Sponsor's sole discretion, including model, style, and color. If for any reason the Grand Prize is unavailable, Sponsor reserves the right to modify the Contest in its sole discretion and award a substitute Grand Prize, or portion of Grand Prize, of comparable or greater value as set forth in these Official Rules. No substitution, transfer, assignment or cash equivalent of the Grand Prize, or any portion thereof, is permitted by a Winner unless otherwise specified. Contest Entities shall have no responsibility or obligation to a Winner or potential Winner who is unable or unavailable to, or who does not for any reason, accept or utilize the Grand Prize. All costs and expenses not specifically listed above as part of the Grand Prize, including any equipment to be used in connection the Grand Prize, is solely Winner’s responsibility. Grand Prize is provided “as is”. Contestants acknowledge that Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Grand Prize, including any express warranties provided by a Grand Prize supplier that are sent along with the Grand Prize. Arrangements for the fulfillment of the Grand Prize will be made by Administrator.
Each winner must supply Administrator and/or Sponsor with a complete and valid IRS Form W-9 prior to receiving Prize. The value of each Prize is taxable to Winner as income. An IRS Form 1099 will be issued in the name of Winner for the actual value of Prize awarded. All federal, state, and local taxes, and any other costs and expenses associated with acceptance and/or use of Prize not specifically provided for in these Official Rules are solely the Winner’s responsibility.
10. General Terms: Contest Entities are not responsible if Contest cannot take place, or if any Grand Prize cannot be awarded due to delays, interruptions, or failures due to pandemic, acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of Contest Entities. If, for any reason Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Contest Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend Contest or any part of the Contest. Sponsor reserves the right to modify and amend these Official Rules from time to time during Contest for clarification purposes without materially affecting the terms and conditions of Contest.
Contestants agree to indemnify and hold harmless Contest Entities from all liability arising out of or relating in any way to Contestant’s participation in Contest and to release all rights to bring any claim, action or proceeding against Contest Entities. Contest Entities assume no responsibility for and will disqualify sales that are: fraudulent, late, lost, incomplete, invalid, not received, or that have incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in Contest, or by any human, mechanical or electronic error. Contest Entities assume no responsibility for any typographical or other error in the printing of the offer, administration of Contest, errors in processing entries, identifying the Winner, in the announcement of the Grand Prize and Winner, and the delivery of the Grand Prize. Use of any device to automate or subvert entry is prohibited and any entries received by such means will be void. Sponsor reserves the right in its sole discretion to disqualify any person they suspect or find: (i) to have tampered with the entry process or the operation of Contest; (ii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iii) to display behavior that will bring such Winner or Contest Entities into disgrace; (v) to have provided inaccurate information on any legal documents submitted in connection with Contest; or (vi) to be acting in violation of these Official Rules. ANY
VIOLATION OF THESE OFFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE CONTEST AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE
CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR
RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO
THE FULLEST EXTENT PERMITTED BY LAW. THE TEXAS COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION
OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF TEXAS SHALL GOVERN THE CONTEST. EACH CONTESTANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THESE COURTS.

2. Entry Period: The TELOGIX Authorized Dealer Electrified Truck Contest (“Contest”) commences at 12:00 AM CT on March 1, 2024, and ends at 11:59 PM CT on December 30, 2024 (“Contest Period”). All interpretations of these Official Rules and decisions made by Sponsor relating to the Contest are final.
3. Eligibility: The Contest is open to legal residents of the 50 United States and District of Columbia who are registered with PerfectVision and an authorized dealer principal, corporation member or owner of an active and compliant TELOGIX Authorized Dealer business entity (further known as CONTESTANT). At any time during this contest, eligible entities or sole proprietors may apply and register to become an authorized dealer through the PerfectVision Authorized Retailer Program by calling 1-855-889-6688.
TELOGIX, LLC (“TELOGIX” or “Sponsor”), and its respective parent companies, affiliated companies, subsidiaries, partners, dealers, manufacturers, distributors, sponsors, advertising agencies, promotion and administration agencies and any entity which is involved in any aspect of the creation, production, operation, execution or fulfillment of Contest, and their respective agents, employees, officers, directors, successors and assigns, together with the Sponsor and Administrator will hereinafter be referred to as (“Contest Entities”). By participating in this Contest, contestants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor and by the decisions of Sponsor; (b) acknowledge compliance with these Official Rules; (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and, (d) agree to release and hold harmless Contest Entities from and against any and all claims, injury or damages arising out of or relating to participation in the Contest and/or the use, misuse or redemption of the Grand Prize (hereinafter defined), and for any claim including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action. These Official Rules do not constitute an employment agreement or impose on TELOGIX any obligation to retain any Contestant as an employee, agent, dealer, or independent contractor and does not prevent TELOGIX or any Contestant from terminating any contractual relationship at any time. Participation and prize award are subject to any applicable TELOGIX personnel and corporation policies or restrictions concerning programs such as this Contest.
4. Contest Overview: This is a sales competition based upon the amount of direct aggregate TELOGIX Hosted PBX seats/extension (“TPBX”) new sales during the Contest Period.
a. Baseline (TELOGIX Authorized Dealers with PerfectVision ONLY): The Baseline Target at the beginning of the contest period will be an Authorized Dealer aggregate sum of 2,500 gross new contracted handsets sold for no less than $19.95 each. Any cancelation or non-payment resulting in default, occurring within 90 days of the sales contract date will be disqualified from the contest. New Authorized Dealers added to the program after the contest period has started will be included in the baseline target without penalty or additional requirement. Any inquiry or dispute regarding the Baseline Average must be sent to ETC2024@TELOGIX.com.
b. The Winner will be the Contestant with the highest overall number of TPBX sales. In the event of a tie, Sponsor will choose a Winner, in its sole discretion, based upon the following criteria in order of priority: (1) sum of tying Contestants’ TPBX new sales revenue;(2) total volume of tying Contestants’ TPBX sales; and (3) total tying Contestants’ new sales revenue. TELOGIX reserves the right, in its sole discretion, to disqualify any sales that it deems to be a violation of these Official Rules or any other applicable TELOGIX policy.
5. To Enter:
a. Baseline: The primary, secondary, or commission contacts of TELOGIX Authorized Dealers must opt-in to the contest by approving these Terms & Conditions via Zomentum Partner Access under Telogix Partner Align Agreement
(unless otherwise changed) within the contest period. Failure to do so will result in disqualification from the incentive.
b. Sweepstakes: Upon obtaining a sale, it will be the authorized dealer's responsibility to verify the sale has been commissioned in the Zomentum Partner Portal by the opportunity being at a 'won' status and all documentation signed by the customer and processed by Telogix before the Contest Period closes to be qualified for the Grand Prize. If the contestant does not enter in the required information prior to the end date/time of the Contest Period, the contestant will be disqualified.
6. Grand Prize:
Tesla Cybertruck Cyberbeast Foundry Edition. In compliance with Tesla Cybertruck purchase agreement. Winner will receive a 12 month no cost vehicle on lease agreement. After 12 months, sponsor will provide sales order, agreement, and title free and clear to contest winner. Winner is also responsible for:
(1) all taxes, title, registration, license plate fees, and documentation fees.
(2) full coverage auto insurance in which Telogix, LLC is to be named in said policy as a loss payee (and shall be maintained in effect throughout the lease term, or until the vehicle is surrendered to Telogix, LLC or its designee).
(3) all costs associated with any upgrade/option that is not included with the Grand Prize; and
4) regular maintenance along with the costs related to any excessive wear and tear of the vehicle. Winner must have a valid U.S. driver’s license and proof of insurance to take delivery of Grand Prize.
All Grand Prize details are determined in Sponsor's sole discretion, including model, style, and color. Grand Prize is non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.
7. Winner Selection and Notification:
a. Baseline: Any disputes regarding the contestant’s status in the competition must be sent to ETC2024@TELOGIX.COM
within the Contest Period. Any disputes sent after the Contest Period closes will not be considered. TELOGIX will determine the Winner based upon a review of final sales reports from the Zomentum Partner Sales & Opportunity share/track platform for the Contest Period which will occur on December 30, 2024. TELOGIX will announce the Winner at the New Year’s Eve Celebration at PerfectVision's Headquarters or via YouTube Live Stream on December 31st, 2024, at 10PM CST.
b. Sweepstakes: The winning entry will be announced live. Attendance is not required to win.
8. Affidavit of Eligibility and Releases: TELOGIX, in its sole and absolute discretion, may require that, in order to be eligible to be declared a Winner and to receive the Grand Prize, the potential winner must sign: (a) an Affidavit of Eligibility and Release releasing Contest Entities from any and all liability, loss, claims, demands, and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss, or any other harm suffered directly or indirectly from potential winner’s participation in Contest, including, but not limited to, traveling to, preparing for and/or participating in any Grand Prize related activity, or the acceptance, possession, or use or misuse of any Grand Prize, to be eligible for the Grand Prize; and (b) except where prohibited by law, a publicity release granting Contest Entities the right to use potential winner’s name, picture and/or likeness, or biographical information or voice for trade, advertising and publicity purposes, in any media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration or notification. If potential winner does not sign these releases and documents within the time frame specified, the potential winner may be disqualified, and the Grand Prize forfeited. When properly executed, and providing potential winner follows the Official Rules, potential winner will be determined to be the Winner (“Winner”). Sponsor expressly reserves the right to delay the announcement of the Winner for any reason Sponsor deems necessary. Winner also must acknowledge that Contest Entities have not and will not obtain or provide insurance of any kind relating to the Grand Prize and that Winner will be responsible for obtaining and paying for any life, travel, car, accident, property, or other form of insurance relating to the Grand Prize. Winner must also complete any additional legal documents provided by Administrator or Sponsor with respect to the Grand Prize and return them as instructed within the time frame specified or Winner may forfeit Grand Prize at Sponsor’s sole discretion and an alternate potential winner may, in Sponsor’s sole discretion, be chosen from among all the remaining Eligible Entries received.
9. Grand Prize Terms: Subject to the availability of the prize from the manufacturer and supplier(s) thereof, Grand Prize will be fulfilled within approximately 2 weeks after the Winner is announced, but subject to change in Sponsor’s sole discretion. All prize details are determined in Sponsor's sole discretion, including model, style, and color. If for any reason the Grand Prize is unavailable, Sponsor reserves the right to modify the Contest in its sole discretion and award a substitute Grand Prize, or portion of Grand Prize, of comparable or greater value as set forth in these Official Rules. No substitution, transfer, assignment or cash equivalent of the Grand Prize, or any portion thereof, is permitted by a Winner unless otherwise specified. Contest Entities shall have no responsibility or obligation to a Winner or potential Winner who is unable or unavailable to, or who does not for any reason, accept or utilize the Grand Prize. All costs and expenses not specifically listed above as part of the Grand Prize, including any equipment to be used in connection the Grand Prize, is solely Winner’s responsibility. Grand Prize is provided “as is”. Contestants acknowledge that Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Grand Prize, including any express warranties provided by a Grand Prize supplier that are sent along with the Grand Prize. Arrangements for the fulfillment of the Grand Prize will be made by Administrator.
Each winner must supply Administrator and/or Sponsor with a complete and valid IRS Form W-9 prior to receiving Prize. The value of each Prize is taxable to Winner as income. An IRS Form 1099 will be issued in the name of Winner for the actual value of Prize awarded. All federal, state, and local taxes, and any other costs and expenses associated with acceptance and/or use of Prize not specifically provided for in these Official Rules are solely the Winner’s responsibility.
10. General Terms: Contest Entities are not responsible if Contest cannot take place, or if any Grand Prize cannot be awarded due to delays, interruptions, or failures due to pandemic, acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of Contest Entities. If, for any reason Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Contest Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend Contest or any part of the Contest. Sponsor reserves the right to modify and amend these Official Rules from time to time during Contest for clarification purposes without materially affecting the terms and conditions of Contest.
Contestants agree to indemnify and hold harmless Contest Entities from all liability arising out of or relating in any way to Contestant’s participation in Contest and to release all rights to bring any claim, action or proceeding against Contest Entities. Contest Entities assume no responsibility for and will disqualify sales that are: fraudulent, late, lost, incomplete, invalid, not received, or that have incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in Contest, or by any human, mechanical or electronic error. Each winner must supply Administrator and/or Sponsor with a complete and valid IRS Form W-9 prior to receiving Prize. The value of each Prize is taxable to Winner as income. An IRS Form 1099 will be issued in the name of Winner for the actual value of Prize awarded. All federal, state, and local taxes, and any other costs and expenses associated with acceptance and/or use of Prize not specifically provided for in these Official Rules are solely the Winner’s responsibility.
10. General Terms: Contest Entities are not responsible if Contest cannot take place, or if any Grand Prize cannot be awarded due to delays, interruptions, or failures due to pandemic, acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of Contest Entities. If, for any reason Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Contest Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend Contest or any part of the Contest. Sponsor reserves the right to modify and amend these Official Rules from time to time during Contest for clarification purposes without materially affecting the terms and conditions of Contest.
Contestants agree to indemnify and hold harmless Contest Entities from all liability arising out of or relating in any way to Contestant’s participation in Contest and to release all rights to bring any claim, action or proceeding against Contest Entities. Contest Entities assume no responsibility for and will disqualify sales that are: fraudulent, late, lost, incomplete, invalid, not received, or that have incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in Contest, or by any human, mechanical or electronic error. Contest Entities assume no responsibility for any typographical or other error in the printing of the offer, administration of Contest, errors in processing entries, identifying the Winner, in the announcement of the Grand Prize and Winner, and the delivery of the Grand Prize. Use of any device to automate or subvert entry is prohibited and any entries received by such means will be void. Sponsor reserves the right in its sole discretion to disqualify any person they suspect or find: (i) to have tampered with the entry process or the operation of Contest; (ii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iii) to display behavior that will bring such Winner or Contest Entities into disgrace; (v) to have provided inaccurate information on any legal documents submitted in connection with Contest; or (vi) to be acting in violation of these Official Rules. ANY
VIOLATION OF THESE OFFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE CONTEST AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE
CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR
RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO
THE FULLEST EXTENT PERMITTED BY LAW. THE TEXAS COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION
OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF TEXAS SHALL GOVERN THE CONTEST. EACH CONTESTANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THESE COURTS.
